Among the Duties of the Ruler…

Imam as-Subki states in his Mufeed an-Ni'am wa-Mubeed an-Niqam:

فمن وظائف السلطان: تجنيد الجنود، وإقامة فرض الجهاد لإعلاء كلمة الله، فإن الله تعالى لم يوله على المسلمين ليكون رئيسًا آكلًا شاربًا مستريحًا، بل لنصر الدين ويعلي الكلمة  

One of the duties of the Sultan is to recruit soldiers and establish the obligation of jihad to exalt the word of Allah. Indeed, Allah Almighty did not appoint him over the Muslims to be merely a leader who eats, drinks, and rests, but rather to support the deen and elevate the kalimah.

He also says:

ومن وظائف السلطان النظر في الدين والصلوات، ولقد رأينا منهم من يعمر الجوامع ظانًا أن ذلك من أعظم القرب، فينبغي أن يفهم مثل هذا الملك أن إقامة جمعتين في بلد لا يجوز عند الشافعي وأكثر العلماء، فإن قال: قد جوزها قوم، قلنا له: إذا فعلت ما هو واجب عليك عند الكل فذاك الوقت افعل الجائز عند البعض، وأما أن ترتكب ما نهى الله عنه وتترك ما أمر به، ثم تريد أن تعمر الجوامع بأموال الرعايا ليقال: هذا جامع فلان، فلا؛ والله لن يتقبله الله تعالى أبدًا، وإن الله سبحانه طيب لا يقبل إلا طيبًا

Among the duties of the Sultan is to oversee religious matters and prayers. We have observed some who build masjids, believing that this is among the greatest acts of piety. Such a ruler should understand that establishing two Friday prayers in one town is not permissible according to al-Shafi'i and most scholars. If he argues that some have permitted it, we say to him: once you fulfill what is obligatory upon you according to all, then you may do what is permissible according to some. However, to commit what Allah has forbidden and neglect what He has commanded, then seek to build masjids with the wealth of the subjects just to have them named after you, is not acceptable. By Allah, He will never accept it. Indeed, Allah is good and accepts only that which is good.
